These Terms of Service (“Terms”) are a legal agreement between you and Nakamoto Games (“Nakamoto Games”, “we”, “us” or “our”) governing your access to and use of the Fall Race video game, including any related services, features, content, and software (collectively, the “Game”). By installing, accessing, or playing Fall Race, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our separate Privacy Policy (which explains how we collect and handle personal data). If you do not agree with these Terms or the Privacy Policy, you must not use the Game. PLEASE READ THESE TERMS CAREFULLY. They include important provisions that affect your rights, including disclaimers of warranties, limitations of liability, and a binding arbitration clause (if applicable in your jurisdiction). Use of the Game is void where prohibited by law. If you are under the legal age of majority in your country, your parent or legal guardian must review and agree to these Terms on your behalf.

By playing as a guest or creating an account, you confirm that you meet the above requirements. If at any time we discover that you do not meet the eligibility criteria, we may suspend or terminate your access to the Game.

Guest Access: You may access Fall Race as a guest without creating a full account. When playing as a guest, the Game may prompt you to provide your age (for content and privacy compliance) but will not require full registration. Please note: If you play on a guest account, your game progress and purchases are stored locally on your device and are not guaranteed to be recoverable if you lose access to that device or delete the app. Guest accounts do not support cross-device use or cloud saving. For example, if you uninstall the Game or switch to a new device while using a guest profile, your progress, items, and any in-app purchases may be permanently lost. Similarly, if you later choose to link to or log in with a permanent account (described below) without first saving or transferring your guest data, the guest account data could be erased. We strongly recommend creating or linking an account to safeguard your progress, especially if you intend to make in-game purchases.

Account Registration and Linking: Fall Race allows you to register a persistent user account or link to an existing account for a more secure and enhanced experience. You may have the option to create an account through the Nakamoto Games platform (e.g., using a “Nakamoto ID”) or to log in via supported third-party identity providers such as Google (or other platforms as offered). When you choose a third-party login (Google, Apple, Nakamoto Games, etc.), you authorize us to obtain certain information from that provider to establish your Fall Race profile (for example, your display name and a unique identifier). You are responsible for ensuring any registration information you provide to us is truthful, accurate, and up-to-date. Multiple account creation or false information is prohibited (do not create an account under someone else’s name or a fake identity).

By registering an account (or converting a guest profile to a full account), you will be able to preserve game data across devices, participate in competitive features (like leaderboards or tournaments), and restore purchases on new devices. Account Security: When you create or link an account, you may be required to choose a secure password or use credentials from your chosen login provider. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Do not share your account or password with anyone. You agree not to sell, rent, license, transfer, or give away your account to any other person. Account sharing and account trading are strictly forbidden; if you share or transfer your account, we are not liable for any loss or damage that result, and we may not be able to assist in recovering the account. In addition, buying or selling accounts or login credentials may result in a permanent ban of the account in question.

You must notify us immediately (via our contact information in Section 12) if you suspect any unauthorized use of your account or security breach. We are not responsible for any losses arising from unauthorized access to your account, and you may be held liable for losses incurred by us or others due to such unauthorized use. We reserve the right to reclaim or terminate inactive accounts or accounts that violate these Terms. Accounts are the property of Nakamoto Games – even though you use and may have created your account, you do not own the account itself or any virtual items or content associated with it. We grant you a limited, revocable license to use the account for the purposes of the Game, as long as you comply with these Terms. Nakamoto Games may suspend, delete, or reclaim any account at our sole discretion, especially if we determine that the account has been involved in misconduct, fraud, or other violations of these Terms.

Fall Race is an online multiplayer game that enables real-time interaction with other players. This makes it fun and competitive, but it also means you must adhere to certain standards of conduct to maintain a safe and enjoyable environment for everyone. By using any online features of the Game (including participating in matches, chat or messaging systems, player forums, or any other community features), you agree to behave lawfully, respectfully, and in accordance with these Terms and all applicable rules.

Prohibited Conduct: You must not engage in any of the following behaviors, and you agree that violating these rules may result in immediate suspension or termination of your access to the Game (as detailed in Section 9 below):

• Harassment and Hateful Behavior: Do not harass, bully, or threaten other players. Avoid any language or content that is abusive, obscene, vulgar, defamatory, libelous, sexually explicit, or otherwise offensive. This includes slurs or comments attacking someone on the basis of race, ethnicity, nationality, religion, gender, sexual orientation, or other protected characteristics. Hate speech or encouraging harm or violence to anyone is strictly forbidden. Be respectful in all communications. Nakamoto Games reserves the right to monitor in-game chats or communications (to the extent permitted by law) and to remove or restrict your communication privileges if you engage in misconduct.
• Cheating and Unfair Play: You may not use cheats, bots, automation software, hacks, mods, or any unauthorized third-party software or tools to modify or interfere with the Game. Exploiting bugs or glitches to gain an unfair advantage is also prohibited. You agree not to design, distribute, or promote any programs or scripts that facilitate cheating in Fall Race. All players should compete fairly – any form of cheating, exploiting, or stat padding ruins the experience and may result in an immediate ban.
• Hacking and System Interference: Do not attempt to probe, scan, or hack our servers or networks. You must not upload viruses, Trojan horses, worms, spyware, malicious code or do anything that could disrupt, damage, or interfere with the Game’s operation or other users’ devices. Similarly, you may not attempt to gain unauthorized access to the accounts of others or to data or systems of the Game. Any attempt to attack or disrupt our service (including DDoS attacks, mail flooding, or overloading) or to circumvent security measures is a serious violation that could lead to termination and potential legal action.
• Impersonation and Illegal Activities: You may not impersonate any other person (be it another player, a moderator, or a Nakamoto Games employee) or misrepresent your affiliation with any person or entity. You must not use the Game to engage in any unlawful behavior. This includes, for example, activities like gambling, fraud, or exchange of real-world illegal substances. Any content that violates any law or infringes anyone’s rights (including intellectual property rights or privacy rights) is strictly disallowed.
• Spam and Unauthorized Commercial Use: The Game’s communication tools (such as chat) are for personal and entertainment use only. You must not use Fall Race or its services to advertise or solicit any products, services, or commercial activities without our express permission. Do not send unsolicited bulk messages, repetitive promotions, or any form of spam. Also, you may not sell, trade, or promote the sale of any in-game accounts, items, or services outside the authorized mechanisms of the Game. Any such transactions are not sanctioned by Nakamoto Games and are against these Terms.

By adhering to these rules, you help keep Fall Race fun and safe. User-Generated Content: If the Game allows you to create a player profile, avatar, chat messages, or other content visible to others (“User Content”), you agree that your User Content will also comply with the above standards. We do not pre-screen all User Content, but we reserve the right to remove or disable any content that violates these Terms or is otherwise objectionable, and to suspend or terminate the account responsible. You understand that when you interact with others in an online game, their behavior is out of our control; Nakamoto Games is not responsible for other players’ conduct or content, but we encourage players to report abuse to help us take appropriate action.

In-App Purchases: Fall Race is free to download and play, but it offers optional in-game purchases. These may include virtual currency (for example, “Diamonds”) and other virtual goods such as Lucky Boxes, Character Boxes, costumes, power-ups, or other digital items (collectively, “Virtual Items”). You can purchase Virtual Items within the Game using real money (via the Apple App Store, Google Play Store, Naka platform, or other authorized distribution channels, depending on your device/platform). In some cases, you might also earn or obtain certain Virtual Items through gameplay (e.g., rewards or events), but the primary method to acquire many Virtual Items (such as premium currency) will be by buying them with real funds.

When you make a purchase, you will be shown the price and details for the Virtual Item before you confirm. All charges and payments for Virtual Items are final and non-refundable, except as otherwise expressly indicated by us or required by applicable law. Once you purchase an in-game item or currency, you do not own it; rather, you receive a limited, personal, revocable license to use that item or currency within the Game in accordance with these Terms. Virtual Items have no cash value outside of the Game and cannot be exchanged for real money or real goods. They are purely digital assets intended for your entertainment. This means (among other things) that you cannot sell or redeem Virtual Items for “real world” money, and any purported transfers or sales of Virtual Items outside the official Game platform are strictly prohibited.

License and Usage of Virtual Items: All Virtual Items (including any in-game currency like Diamonds) remain the property of Nakamoto Games. When you acquire Virtual Items, whether by purchase or by earning them in-game, you are obtaining a limited, non-transferable, non-sublicensable, revocable license to use those items only within Fall Race for personal, non-commercial gameplay. You do not have any ownership or proprietary interest in the Virtual Items; they are not your personal property. As the owner of the Game content, Nakamoto Games retains the right, in its sole discretion, to manage, regulate, modify, or remove Virtual Items (or prices of Virtual Items) without liability to you. For example, we may add, alter, or remove certain Virtual Items or may adjust their functions or value as part of ongoing game balancing or updates. We will endeavor to avoid any changes that unfairly disrupt the experience, but the availability and functionality of Virtual Items are not guaranteed. The existence of a particular Virtual Item in the Game at one time is not a promise that it will continue to be available in the future.

No Refunds; Non-Transferability: Except where required by law or explicitly permitted in these Terms, purchases of Virtual Items are non-refundable and non-exchangeable. Once you have obtained a Diamond package or a Lucky Box, the transaction is complete and final. Please review your purchases carefully before confirming. If you are a resident of a jurisdiction that provides statutory rights to refunds for digital purchases (such as certain rights of withdrawal for EU consumers within 14 days of purchase), we honor those rights as applicable; however, note that in many cases (for instance, purchasing consumable virtual content), you may be asked to expressly acknowledge that you waive any right of withdrawal once the digital content is delivered immediately. Outside of any legal rights, we generally cannot provide refunds for Virtual Item purchases, including cases where you have remaining Virtual Currency in your account but decide to stop playing. Furthermore, Virtual Items cannot be transferred or gifted to other users, other accounts, or into other games, except only if and where expressly allowed within the Game mechanics. Any attempt to trade, sell, or exchange Virtual Items (or account access to obtain Virtual Items) outside the Game is a violation of these Terms and may result in account termination.

Platform Purchase Process: All real-money transactions for Fall Race are handled by third-party platform providers (for example, Apple for iOS devices, Google for Android devices, or the Naka platform for PC). Nakamoto Games does not collect or store your financial information (such as credit card numbers) for in-app purchases. Payment processing and order fulfillment are carried out through the platform’s app store and are subject to that platform’s terms and conditions and privacy policies. For instance, purchases on an iPhone are processed by Apple’s App Store, and on Android by Google Play. Please ensure you also comply with the payment terms of your platform provider. If a purchase fails or experiences an error, you may need to contact the platform’s support. Nakamoto Games has no ability to reverse charges or provide refunds through these external stores. Additionally, taxes or transaction fees may be applied by the platform or your payment provider; any such charges are your responsibility.

Guest Accounts and Purchases: As noted in Section 2, if you make in-app purchases on a guest account (one not linked to a permanent account login), there is a risk you could lose access to those purchases if the guest data is lost. We highly encourage you to link your account before spending money in-game. Nakamoto Games is not obligated to restore or replace Virtual Items on a guest profile that is lost due to device change, deletion, or failure to save progress. We will make reasonable efforts to assist with account issues, but we cannot guarantee retrieval of guest account purchases.

Virtual Item Policy Acknowledgment: By purchasing or using any Virtual Item, you agree to this Virtual Items Policy. You acknowledge that Virtual Items have no real-world monetary value, cannot be redeemed for cash, and are not your personal property. Any balance of Virtual Currency shown in your account does not constitute a real-world balance or reflect any stored value, but rather measures the extent of your limited license. We may also from time to time award or distribute free or promotional Virtual Items, which are subject to the same terms. All Virtual Item purchases are voluntary and not necessary to enjoy the Game, but they can enhance your experience. If you have any questions about charges or billing, please contact us (see Section 12).

All intellectual property and proprietary rights in and to Fall Race are owned by Nakamoto Games or its licensors. This includes the Game software code, title, characters, character names, artwork, graphics, animations, logos, icons, user interface, audio and visual content (such as music, sound effects, and recordings), text, and the design, look and feel of the Game, as well as any related trademarks and service marks. All rights are reserved by the owner. Using Fall Race does not give you any ownership of any intellectual property rights in our Game or in the content you access. These Terms grant you only a limited license to use Fall Race for your personal, non-commercial entertainment, as described below.

Limited License: Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Fall Race on your authorized devices solely for lawful personal entertainment purposes. This license is provided for the user’s enjoyment of the Game only; you may not use the Game for any commercial purpose without our prior written consent. You also may not use any of Nakamoto Games intellectual property (such as logos, game art, or characters) in a way not expressly allowed by us. For example, you are not permitted to copy, reproduce, distribute, display publicly, perform, or create derivative works from any part of the Game or its content, except as allowed by law or with our permission.

Restrictions: Without limiting the foregoing, you agree that you shall not:

• Copy or Modify: You will not copy, reproduce (except for a reasonable number of backup copies for personal use), adapt, merge, alter, or modify the Game or any part of it. You may not reverse engineer, decompile, or disassemble the Game’s software except to the limited extent that applicable law expressly permits it notwithstanding this restriction.
• Derivative Works: You will not create any derivative works based on the Game or its content. For instance, you may not rip graphics or audio from the Game to use in other projects, nor build new games or content using our intellectual property without authorization.
• Commercial Exploitation: You will not sell, rent, lease, license, distribute, or otherwise exploit the Game or any of its parts for commercial purposes. This means you cannot charge others for the right to play the Game, use the Game in an arcade or cyber café for profit without permission, or use the Game to advertise or sell other products.
• Trademarks: All logos, game names (including `Fall Race`), and associated brand identifiers are trademarks or service marks of Nakamoto Games or its affiliates. You are not granted any license or right to use any trademarks. You must not remove or obscure any copyright, trademark, or other proprietary rights notices present in the Game.
• User Generated Content: If the Game allows you to upload or create content (such as player-created levels, designs, or chat messages), you must only upload content that you have the right to use. By posting any content in the Game, you grant Nakamoto Games a worldwide, irrevocable, royalty-free, and sub-licensable license to use, modify, reproduce, distribute, and display that content in connection with providing the Game service. You also promise that your content won’t infringe on others’ rights. We do not claim ownership over your original user-generated content; however, you give us permission to use it as described here and you waive any moral rights you may have in it.

Third-Party Content and IP: Fall Race may include content licensed from third parties (such as music or middleware). All such content remains the property of its respective owners and is protected by intellectual property laws. You must not separate and use any third-party content independently from the Game. If we provide any tools like an editor or allow streaming of gameplay, that is under separate guidelines or policies, which will be provided if applicable.

Feedback: If you send us any feedback or suggestions regarding Fall Race (e.g., ideas for improvements or new features), you understand that we may use such feedback for any purpose, commercial or otherwise, without obligation to you. You hereby grant us a perpetual and irrevocable license to use the feedback you provide, without any compensation or credit to you, and you waive any claim to proprietary rights in such feedback. This is to avoid any misunderstandings as to intellectual property ownership of ideas.

All rights not expressly granted to you in these Terms are reserved by Nakamoto Games. No ownership rights are being transferred or assigned to you through this agreement or through your purchase of any Virtual Items or creation of an account. Unauthorized use of Fall Race or any Nakamoto Games intellectual property is a breach of these Terms and may also violate copyright, trademark, and other laws. We will protect our rights to the full extent of the law.

Your privacy is important to us. Fall Race collects and uses personal data in accordance with our Privacy Policy, which is a separate document detailing our data practices. This includes information such as your age (provided for guest play or age verification), your player name or nickname, device identifiers, IP address, and other information you provide or that we gather to operate the Game’s online features. By using the Game, you acknowledge that you have read and understood the Fall Race Privacy Policy and you agree to the collection, processing, and use of your personal data as described therein. If you do not agree to our handling of your data as explained in the Privacy Policy, please do not play Fall Race.

Personal Information: Generally, we may collect data like your device ID, hardware/model information, operating system, gameplay statistics, and interactions with other players. If you create an account, we will collect the information you provide (such as an email address or account ID from Google or Nakamoto Games). If you make purchases, the platform might share information about the transaction (but not your full payment details) with us for fulfillment and record-keeping. If you use any communication features, we may (consistent with our Privacy Policy) collect and monitor that content to enforce the community standards.

Use of Data: We use personal data to provide and improve the Game’s services – for example, to save your progress, match you with appropriate opponents, enable social features, prevent fraud/cheating, and comply with legal obligations. We may also use it to communicate with you about updates, events, or promotions (if you’ve given consent where required). More details are available in the Privacy Policy.

Age and Parental Consent: As noted, if you are under the age of majority, you should only play with parental consent. We do not knowingly collect personal data from children under 13 without such consent. If we learn we have inadvertently collected personal information from a child under 13 (or the minimum age in the relevant jurisdiction) without proper consent, we will take steps to delete that information as soon as possible.

Privacy Policy Reference: For comprehensive information on what data we collect, how we use it, with whom we share it (such as service providers or partners), and your rights regarding your personal data (including how to access or delete your data), please review the Fall Race Privacy Policy (available at the point of download or on our website). That policy is incorporated into these Terms by reference. If any term in these Terms of Service appears to conflict with the Privacy Policy regarding personal data usage, the Privacy Policy will govern on those issues. By accepting these Terms, you also accept the Privacy Policy.

If you have questions or requests concerning your personal data, you may contact us as outlined in the Privacy Policy or via the contact information in Section 12 of these Terms.

Game Updates: Fall Race is an evolving game. We may from time to time provide patches, updates, or modifications (for example, to add new content or features, to enhance functionality, or to fix bugs). These may be automatically installed without separate notice or may require you to download and install them to continue playing. You consent to such automatic updates. We are not obligated to support the Game indefinitely, and we may change or discontinue certain features or the game in whole or in part. We will try to inform players (via in-game notices or other channels) of major changes that significantly affect gameplay.

Changes to Terms: Nakamoto Games reserves the right to modify these Terms of Service as reasonably needed. If we update the Terms, we will notify users by posting the revised Terms within the Game, on our website, or through other appropriate means. We may also update the “Effective Date” at the top of the Terms. Please check for updates regularly. Once updated Terms are in effect, your continued use of Fall Race constitutes acceptance of the changes. If you do not agree to a material change in the Terms, you should stop using the Game and may contact us to terminate any account you have (subject to the provisions of Section 9 regarding termination). For minor updates or changes required by law, we may not be able to give advance notice, but we will make the updated Terms available.

Suspension or Discontinuation: We hope to keep Fall Race available for a long time, but we may need to suspend or shut down the Game (or certain services/features) at our discretion, for example due to business reasons, technical issues, or if the platform provider (Nakamoto Games, Apple, Google, etc.) ceases to support necessary services. If we decide to permanently discontinue the Game, we will attempt to provide at least 60 days’ prior notice if feasible (e.g., via an announcement on our website or in-game notification). During that notice period you should use any remaining Virtual Currency or items, as after the Game is discontinued they will no longer be available and no refunds will be provided. We do not guarantee the ongoing availability of any online service and shall not be liable for any inability to access the Game or Virtual Items due to an eventual shutdown, except as may be required by law.

We may also temporarily suspend the online service for maintenance or updates. We will try to schedule maintenance at off-peak times and to inform you in advance, but this may not always be possible.

Use at Your Own Risk: Fall Race is provided to you on an “as is” and “as available” basis. Nakamoto Games makes no warranties or representations of any kind, express or implied, about the Game or its performance. To the fullest extent permitted by applicable law, we disclaim all warranties (express, implied or statutory) regarding the Game, including but not limited to any implied warranties of title, non-infringement, accuracy, correctness, merchantability, fitness for a particular purpose, adequate quality, or quiet enjoyment. We do not guarantee that the Game will meet your requirements or expectations, or that it will be uninterrupted, error-free, or free of viruses or other harmful components.

For example, we do not warrant that: (a) the Game will always be available or accessible at any given time or location, (b) any defects or errors will be corrected (although we strive to address bugs), (c) the Game will be compatible with all devices or will function with any particular hardware, or (d) the Game results or accuracy of any content will be reliable. All information and gameplay is subject to change and provided for entertainment purposes.

No Warranty for User Conduct: We also make no guarantees regarding the behavior of other players or third parties, or that the Game’s community features will be safe or free of offensive content. While we provide rules and may moderate, we are not responsible for what each user says or does.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. In such cases, any required warranty is limited to the shortest period and fullest extent allowed by law.

Limitation of Liability: To the maximum extent permitted by law, Nakamoto Games (and its parent, affiliates, subsidiaries, officers, directors, employees, agents, partners, and licensors) shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, or any losses of profits, revenues, business opportunity, goodwill, data, or other intangible losses, arising out of or in connection with your use of (or inability to use) Fall Race. This limitation applies regardless of the legal theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

In particular, Nakamoto Games will not be responsible for:

• Game Interruptions or Data Loss: Any interruption of service, loss of data or game progress, or the inability to access your account or Virtual Items. We recommend that you link your game to an account to minimize loss of data, but ultimately you assume the risk of any data, credits, or rewards earned in-game being lost or unrecoverable.
• Device or Technical Issues: Any damage to your computer, mobile device, console, or other equipment, or any software or data loss that may result from downloading or using our Game. You are responsible for ensuring that any device used to play Fall Race meets the Game’s minimum requirements and is protected by up-to-date antivirus software.
• Third-Party Actions: The conduct or content of any other user or third party within the Game. We are not liable for communications or interactions between players. If you have a dispute with another user, you release us from any claims or damages (past, present, and future) arising out of or connected to that dispute.
• Unauthorized Transactions: Any unauthorized transactions (for example, if someone uses your payment method or account without permission). However, if you notice an unauthorized charge for Fall Race content, please contact the platform (Apple/Google) and us immediately; we will attempt to help resolve genuine cases of fraud.

If, notwithstanding the above exclusions, Nakamoto Games is found liable to you for any damage or loss arising from or connected to your use of Fall Race, the total cumulative liability of Nakamoto Games to you shall not exceed the amount (if any) you have paid to us for the specific service or Virtual Item that gave rise to the claim in the six (6) months immediately prior to the event giving rise to the liability (or, if no purchase is applicable, the sum of USD $50.00 or equivalent in local currency). This allocation of risk is an essential basis of the bargain between you and us, and you acknowledge that we could not provide the Game on an economically feasible basis without these limitations.

Exceptions: Nothing in these Terms limits or excludes our liability for gross negligence, willful misconduct, or fraud, or for death or personal injury caused by our negligence to the extent that liability cannot be excluded or limited as a matter of law. Additionally, because some jurisdictions do not allow the exclusion or limitation of certain damages, some of the above limitations may not apply to you. In such cases, our liability will be limited to the minimum scope and amount permitted by law.

You agree that the limitations of liability in this Section 9 and elsewhere in these Terms will apply even if any limited remedy fails of its essential purpose.

Indemnification: You agree to defend, indemnify and hold harmless Nakamoto Games and its affiliates, officers, agents, employees, and partners from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys` fees) arising out of or in any way connected with your breach of these Terms or your misuse of the Game. This includes, for example, any damage you cause to others through the Game, or any content you upload that infringes another`s rights. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claim.

Your Right to Terminate: You may stop using Fall Race at any time. You may also terminate your account (if you have created one) by contacting us with a request to delete your account, or by using any provided account deletion feature. Keep in mind that upon termination of your account, you will lose access to any Virtual Items, progress, or entitlements associated with that account, and we are not required to provide a refund for any Virtual Items or subscriptions (except where required by law or as expressly provided in these Terms).

Our Right to Suspend or Terminate: We may suspend or terminate your access to the Game (including your account and/or the license to use the Game) at any time, for any reason or no reason, with or without notice. However, we will generally only take such action if you violate these Terms, violate the Community Guidelines/User Conduct rules in Section 3, or engage in illegal or improper use of the Game. For example, if we have reason to believe that you have cheated, hacked, stolen accounts, engaged in harassment, or otherwise materially breached these Terms, we may issue a temporary suspension or a permanent ban on your account. In serious cases or repeated violations, we reserve the right to permanently terminate your account immediately.

If your account is terminated or suspended due to your violations, you will not be entitled to any refund of amounts paid, to any credit or compensation for Virtual Items, nor will we have any liability to you (to the extent permissible by law) for such termination. We may also delete or reset your progress and Virtual Items. These measures are taken to protect the Game and the community. We may also choose to ban your device or take other technical measures to prevent further use by you.

Process: We are not required to provide advance notice before taking action against an account, but we may in some cases send a warning or explanation, especially for less severe issues. If you believe your account has been wrongfully suspended or terminated, you may contact our support to appeal, and we’ll review the case. However, please understand that decisions by our moderation and security team are final in most cases, and we are not obligated to reinstate an account that has been banned for cause.

Effect of Termination: Upon any termination of your account or this agreement, the rights and licenses granted to you by Nakamoto Games will cease immediately, and you must cease all use of Fall Race and delete any copies of the Game in your possession. Sections of these Terms that by their nature should survive termination (such as ownership provisions, disclaimers of warranty, limitations of liability, and governing law) will survive.

Terminating your account or uninstalling the Game will not automatically delete all personal data we hold about you, especially where we are required to retain it for legal reasons. For details on data retention and deletion, please refer to the Privacy Policy. If you wish to have your personal data deleted, you may need to make a specific request as described in the Privacy Policy.

Governing Law: These Terms of Service, and any dispute or claim arising out of or related to them or the Game, shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles. This means that the laws of Thailand will govern any disputes about these Terms or the Game, regardless of where you live or use the Game. If you are using the Game from another jurisdiction, you do so on your own initiative and are responsible for compliance with any local laws, if and to the extent local laws apply.

Jurisdiction: You agree that any legal action or proceeding arising under or relating to this agreement shall be subject to the exclusive jurisdiction of the courts of Thailand. Both you and Nakamoto Games consent to the personal jurisdiction of such courts and waive any objections on grounds of venue or inconvenient forum, to the extent permitted by law. Notwithstanding the foregoing, Nakamoto Games reserves the right to seek injunctive or equitable relief in any competent court to prevent any unauthorized use or abuse of the Game or infringement of our intellectual property rights.

If you are a consumer residing outside Thailand, you may have certain mandatory rights to bring an action in your country of residence under that country’s consumer protection laws. These Terms are not intended to limit any such rights that cannot be waived by contract.

Arbitration (if applicable): At this time, we do not mandate arbitration for disputes, but we reserve the right to institute an arbitration program in the future by updating these Terms, in compliance with applicable laws (we will provide notice and an opportunity to opt-out if required). Otherwise, disputes will be resolved by the courts as stated above.

Time Limits: You agree that any claim or cause of action arising out of your use of the Game or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. (This time limit may not apply to you in jurisdictions that prohibit such time limitations on legal actions.)

Entire Agreement: These Terms of Service (and any other policies or terms incorporated by reference, including the Privacy Policy and any additional rules we may publish for Fall Race) constitute the entire agreement between you and Nakamoto Games regarding the Game. They supersede all prior understandings or agreements (whether oral or written) between you and us regarding the subject matter. Any additional or different terms proposed by you (for example, in any communication) are rejected and will not apply unless expressly agreed to in writing by an authorized representative of Nakamoto Games.

Severability: If any provision of these Terms is held to be unlawful, void, or unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The unlawful or unenforceable provision will be interpreted to accomplish the objectives of the provision to the greatest extent possible under applicable law, and the remaining provisions will remain in full force and effect.

No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Nakamoto Games. If we do expressly waive any breach of these Terms, that waiver shall not be deemed a waiver of any future breach.

Assignment: Nakamoto Games may assign or transfer its rights and obligations under these Terms (for example, in the event of a merger, acquisition, or sale of assets, or by operation of law) without restriction and without notice to you. You may not assign, transfer, or delegate any rights or obligations under these Terms without our prior written consent. Any attempted assignment by you in violation of this provision is null and void.

Third-Party Rights: These Terms are between you and Nakamoto Games and do not give any third parties any rights of enforcement except as expressly provided (for example, platform providers may be third-party beneficiaries of certain provisions of these Terms relating to their services). No other person shall have any rights to enforce any term of this agreement.

Force Majeure: Nakamoto Games will not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure is due to unforeseen events beyond our reasonable control, such as acts of God, war, terrorism, embargoes, acts of civil or military authorities, fires, floods, accidents, network infrastructure failures, strikes or shortages of transportation, facilities, fuel, energy, labor, or materials.

Language: These Terms are provided in the English language. If we provide a translation of the English version of these Terms, the English version will prevail in the event of any conflict or ambiguity, except where prohibited by law. All communications with us (including customer support) should be in English, if possible, to ensure effective response.

Headings: Section titles and headings in these Terms are for convenience and do not affect the interpretation of these Terms.
